Conflicto de competencia suscitado entre el Tribunal Administrativo del Huila y el Juzgado Primero Penal del Circuito para Adolescentes con Función de Conocimiento de Neiva, en torno al trámite de la acción de tutela de la referencia.
Luego de pronunciarse cobre la competencia de la Corte Constitucional para dirimir conflictos de competencia y de reiterar las normas que determinan la competencia en materia de tutela y las reglas para solucionar este tipo de conflictos, se decide el asunto ordenando enviar el expediente al Tribunal Administrativo del Huila para que de forma inmediata tramite la acción de tutela deprecada.

- Primero. DEJAR SIN EFECTOS el auto del veintiocho (28) de enero de dos mil catorce (2014) proferido por el Tribunal Administrativo del Huila, mediante el cual se declaro incompetente para conocer de la accion de tutela presentada por Harold Mauricio Olaya Castro contra la Presidencia de la Republica y el Ministerio de Tecnologias de la Informacion y las Comunicaciones.
- Segundo. REMITIR el expediente al Tribunal Administrativo del Huila, para que de forma inmediata tramite la accion de tutela mencionada.
- Tercero. Por Secretaria General, COMUNICAR al Juzgado 1o Penal del Circuito para Adolescentes con Funcion de Conocimiento de Neiva, Huila, la decision adoptada en esta providencia.
